Nadler to Chair Hearing on the USA PATRIOT Act
Subcommittee will examine the Act’s efficacy and excesses and consider ways to improve this problematic law

WASHINGTON, D.C. – Congressman Jerrold Nadler (D-NY), Chair of the House Judiciary Subcommittee on the Constitution, Civil Rights and Civil Liberties, will chair a hearing tomorrow on the USA PATRIOT Act. The hearing will explore the overall utility of the USA PATRIOT Act and the Intelligence Reform and Terrorism Act, and will specifically look into the shortcomings and excesses of certain overreaching provisions within the Acts and consider whether to modify or dispense with those provisions. The hearing will take place at 10:30am on Wednesday, September 9, 2009, in the Rayburn House Office Building, Room 2141, Washington, D.C.
The USA PATRIOT Act, the USA PATRIOT Act Reauthorization and the Intelligence Reform and Terrorism Act were originally designed to improve the process of federal intelligence gathering. Subsequently, major issues have surfaced with the overall utility of those laws and how they may have restricted the constitutional rights and freedoms of American citizens. In addition to examining the Acts in general, the hearing will focus on certain provisions of the laws which are set to sunset. In particular: the USA PATRIOT Act’s Section 206, which expanded wiretapping powers under FISA, and Section 215, which allowed the federal government broadened access to business and personal records; and, the so-called ‘lone-wolf’ provision, Section 6001(a) of the Intelligence Reform and Terrorism Act, which expanded the categories of potential targets of FISA investigations.
